This End User License Agreement (“Agreement”) is a legally binding agreement between you (“you” or “User”) and Ande Partners LLC, a New Jersey limited liability company (“Company,” “we,” or “us”), governing your access to and use of the KeyTalent mobile application and any related software, content, features, or services made available through the application (collectively, the “Services”). This Agreement is solely between you and Company, and not with Apple Inc. (“Apple”). Apple has no responsibility for the Services or their content. By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not access or use the Services.
1. Eligibility and Intended Audience
The Services are intended solely for individuals who are at least eighteen (18) years of age. By using the Services, you represent and warrant that you are eighteen (18) years of age or older and have the legal capacity to enter into this Agreement. The Services are designed for professional and executive users and are not intended for use by minors.
2. Nature and Purpose of the Services
KeyTalent is a software-based platform that provides structured tools, frameworks, prompts, and informational content intended to support leadership judgment, prioritization, reflection, and professional decision-making in workplace and organizational contexts. The Services are designed to help users think more clearly about situations they are already facing, but they do not provide instructions, recommendations, or directives, and they do not make decisions on a user’s behalf. You acknowledge and agree that you remain solely responsible for all decisions, actions, and outcomes that result from your use of the Services, and that the Services are provided to support, not replace, your independent judgment.
4. How We Use Information
Company uses information collected through the Services to provide, operate, and maintain the Services; authenticate users and manage accounts; communicate with users regarding the Services; provide customer support; monitor performance; debug and improve functionality; conduct internal research and product development using aggregated or de-identified data; enforce Company’s agreements and policies; protect the security and integrity of the Services; and comply with applicable legal obligations. Company does not sell personal information and does not use personal information for targeted advertising, behavioral advertising, cross-context advertising, or data brokering.
5. Sharing and Disclosure of Information
Company may disclose information to trusted third-party service providers that perform services on its behalf, such as hosting, analytics, customer support, and technical infrastructure. These service providers are authorized to use information only as necessary to perform services for Company and are contractually obligated to maintain appropriate confidentiality and security safeguards. Company may also disclose information if required to do so by law or legal process, or if Company reasonably believes disclosure is necessary to comply with legal obligations, enforce agreements, protect Company’s rights or property, or protect the safety of users or others. In the event of a merger, acquisition, restructuring, or sale of assets, information collected through the Services may be transferred as part of the transaction, subject to applicable privacy protections.
6. Data Security
Company implements reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, loss, misuse, alteration, or disclosure. However, no method of transmission or storage is completely secure, and Company cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials. If you believe your account has been compromised, you should contact Company promptly.
7. Data Retention
Company retains personal information for as long as reasonably necessary to provide the Services, fulfill contractual obligations, comply with legal requirements, resolve disputes, and enforce agreements. User-generated content is retained for the duration of an active account unless deleted by the user or requested to be deleted, subject to applicable legal retention requirements. Aggregated or de-identified data may be retained indefinitely.
8. Your Privacy Rights
Depending on your jurisdiction, you may have certain rights regarding your personal information, including the right to request access, correction, or deletion of information, and the right to restrict or object to certain processing activities. Requests may be submitted by contacting Company, and Company may take reasonable steps to verify your identity before responding. Certain requests may be limited or denied where permitted by law. Company will not discriminate against users for exercising applicable privacy rights.
9. International Users
The Services are operated from the United States. If you access the Services from outside the United States, you understand and agree that your information may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. For users located in the European Economic Area, United Kingdom, or Switzerland, Ande Partners LLC acts as the data controller for purposes of applicable data protection laws.
10. Children’s Privacy
The Services are intended solely for individuals eighteen (18) years of age or older. Company does not knowingly collect personal information from individuals under eighteen (18).
11. Changes to This Privacy Policy
Company may update this Privacy Policy from time to time to reflect changes in practices, technology, legal requirements, or the Services. When material changes are made, the effective date will be updated and notice may be provided through the Services or other appropriate means. Continued use of the Services after changes become effective constitutes acceptance of the updated Privacy Policy.
